Your order is not accepted until StylishXHouse confirms acceptance. We must receive and process your payment prior to order acceptance. Please review your order thoroughly before submission; StylishXHouse may not be able to honour cancellation requests once an order has been accepted. If we reject, modify or cancel an order, we will attempt to notify you via the email address, billing address and/or phone number you provided at checkout.

We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs clearance or events outside our control. Title and risk of loss for goods pass to you once products are handed over to the shipping carrier.

All other names, logos, product‑and‑service names, designs and slogans appearing within the Services are trademarks of their respective owners.

You may be given access to third‑party customer tools as part of the Services. We do not monitor, control or exercise input over those third‑party tools.

You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising out of or connected with your purchases and transactions with StylishXHouse.

Additionally you agree not to: (a) upload or transmit viruses or other malicious code that may disrupt Service functionality or operation; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track other people’s personal information; (d) spam, phish, pharm or pretext the Services; (e) deploy robots, spiders, scrapers, data‑gathering tools, automated devices or processes, AI agents or automated/manual means to access the Services; (f) interfere with, bypass or circumvent security or authorisation features, robot‑exclusion headers or other access‑restriction measures we implement.

WE DO NOT WARRANT THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR‑FREE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER STYLISHXHOUSE, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, NOR THOSE OF SHOPIFY AND ITS AFFILIATES, SHALL BE LIABLE FOR ANY INJURY, LOSS, CLAIM OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST SAVINGS, DATA LOSS OR REPLACEMENT COSTS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS OBTAINED THROUGH THE SERVICES, OR FROM ANY CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR PRODUCTS, INCLUDING WITHOUT LIMITATION CONTENT ERRORS OR OMISSIONS, OR ANY LOSS OR DAMAGE INCURRED FROM USING THE SERVICES OR ANY POSTED, TRANSMITTED OR OTHERWISE AVAILABLE CONTENT OR PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SECTION 18‑INDEMNIFICATION

You agree to indemnify, defend and hold harmless StylishXHouse, Shopify, their affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from all losses, damages, liabilities and claims (including reasonable attorney fees) asserted by third‑parties arising out of: (1) your breach of these Terms of Service or documents incorporated by reference; (2) your violation of any law or third‑party right; or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim. Failure by us to provide prompt notice shall not relieve your indemnification obligations unless you suffer material prejudice as a result. We may control defence and settlement of such claim at your expense, including selection of counsel; however we will not settle claims requiring non‑monetary performance from you without your consent (consent not to be unreasonably withheld). You shall cooperate in defending indemnified claims and supply relevant documentation.

SECTION 19‑SEVERABILITY

If any provision of these Terms of Service is found unlawful, void or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms, and such finding shall not affect the validity and enforceability of remaining provisions.

SECTION 20‑WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.

These Terms of Service together with all policies and operating rules published by us relating to the Services constitute the entire agreement between you and us governing your use of the Services and supersede all prior or contemporaneous oral or written agreements, communications and proposals (including earlier versions of these Terms of Service). Ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent; any purported attempt shall be null and void. These Terms of Service and any separate agreements under which we provide Services to you shall be governed by and construed under the federal and state or territorial laws of the jurisdiction where StylishXHouse is headquartered. You and StylishXHouse submit to the personal and venue jurisdiction of those courts.
